One of the biggest problems with American police law is that there's no distinction between reserving one's rights, and "resisting".
So, cop asks you X:
1. You do it, if you had the right not to, you just waved that right
2. You don't do it, you have the right not to, the cop knows it -> He says okay
3. You don't do it, you don't have the right not to -> you get beaten
4. You don't do it, you have the right not to, the cop doesn't know it -> you get beaten, but you can sue

There's a principle in law that if an agreement is deemed to be impossible for a reasonable person to predict, then it's considered gambling because it's random. This ought to apply equally to matters of law which are unknowable.
